29 CFR 1910.178(l)(1)(ii): Prior to permitting an employee to operate a powered industrial truck (except for training purposes), the employer shall ensure that each operator has successfully completed the training required by this paragraph (l), except as permitted by paragraph (l)(5).     On or about May 18, 2018, located on the west side of a residential structure, employees were operating a Pettibone Rough Terrain Forklift Truck Model #636 that had not received training as required by this subpart. The employer did not ensure employees had successfully completed the required training prior to operating a powered industrial truck.

29 CFR 1926.20(b)(2): Such programs shall provide for frequent and regular inspections of the job sites, materials, and equipment to be made by competent persons designated by the employers.    On or about May 18, 2018, there were no frequent and regular inspections being performed by a competent person in that employees were working from a third story floor structure at fall heights greater than 10 feet above the next lower level without a fall protection system; wood trusses in excess of 30 feet were installed without an adequately braced support system; multiple improperly braced wood trusses in excess of 30 feet immediately collapsed when a heavy load of plywood sheeting was placed on the trusses; and wood trusses in excess of 30 feet were not installed in accordance with the Building Designer-approved Construction Documents provided to the employer during floor truss delivery.

29 CFR 1926.501(b)(1): "Unprotected sides and edges." Each employee on a walking/working surface (horizontal and vertical surface) with an unprotected side or edge which is 6 feet (1.8 m) or more above a lower level shall be protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.    On or about May 18, 2018, located on the west side of a residential structure, employees were receiving a heavy load of plywood sheeting while standing on a third story floor structure with unprotected sides and edges and not utilizing a fall protection system. Potential fall heights were measured to be greater than 10 feet above the next lower level.

29 CFR 1926.503(a)(1): The employer shall provide a training program for each employee who might be exposed to fall hazards. The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards.    The employer did not provide a training program for employees that were performing framing work on a commercial third story floor structure while not utilizing a fall protection system and exposed to fall heights greater than 10 feet above the next lower level.
