29 CFR 1926.651(j)(2): Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary:  (a)  Defina Construction, at 2100 Alpine Drive, Vail, CO 81657:  On and before May 22, 2018, the exposing employer did not ensure that the spoil pile was set back 2 feet or barricaded with retaining devices.  A spoil pile was set immediately adjacent to a trench wall with no retaining devices in use.  This condition exposed employees to cave-in hazards.

29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems, hazardous atmosphere, or other hazardous conditions:  (a)  Defina Construction, at 2100 Alpine Drive, Vail, CO 81657:  On and before May 22, 2018, the exposing employer did not ensure that daily inspections of excavations, the adjacent areas, and protective systems were made by a competent person.  Employees were working in an excavation approximately 8 feet deep without a trench box, shoring, or adequate sloping.  The employer did not perform a competent person inspection and ensure the trench was safe prior to employees working in the trench.  This condition exposed employees to cave-in hazards.
