29 CFR 1903.19(c)(1):   The employer did not certify to OSHA, within 10 calendar days after the abatement date, that the cited violation had been abated:  (a)  The employer failed to certify that Citation 1, Item 1 issued on 06/07/2018 with an abatement date of 06/19/2018 had been abated.  (b)  The employer failed to certify that Citation 1, Item 2 issued on 06/07/2018 with an abatement date of 07/03/2018 had been abated.  (c) The employer failed to certify that Citation 1, Item 3 issued 06/07/2018 with an abatement date of 6/19/2018 had been abated.  (d) The employer failed to certify that Citation 1, Item 4 issued 06/07/2018 with an abatement date of 07/03/2018 had been abated.

29 CFR 1926.501(b)(13):  Each employee engaged in residential construction activities 6 feet or more above lower levels was not protected by guardrail systems, or personal fall arrest systems:     The employer is failing to ensure employees are protected from fall hazards when conducting installation of shingles as part of re-roofing operations.  Workers were observed installing shingles on a residential style construction site (house) without utilizing fall protection.  The workers were exposed to falls of over 10 feet to concrete below.  This was most recently documented at 424 W, Cuming St., Linocln, Nebraska on or about June 4, 2018 when the employer had employees working on the roof of this residence without any form of protective system.

29 CFR 1926.503(a)(1):  The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:      The employer is failing to provide employees with adequate and effective fall protection training prior to allowing them to work on a residential style roof. Workers were observed installing shingles on a residential style construction site (house) without utilizing fall protection.  This training would allow each employee to recognize the hazards of falling and allow them to understand the proper procedures to be followed in order to minimize these hazards.  The workers were exposed to falls of over 10 feet to dirt and concrete below.  This was most recently documented at 424 W. Cuming St., Lincoln, Nebraska on or about June 4, 2018 when the employer had employees working on the roof of this residence without any form of protective system and had not provided any training to them.

29 CFR 1926.1053(b)(9): The area around the top and bottom of ladders was not kept clear:   The employer is failing to ensure employees are protected from fall hazards while utilizing portable ladders as part of re-roofing operations.  The area at the top of the ladder on site was entangled with air hoses that were running from the air compressor on the ground, up the ladder and through the upper portion of the ladder and to the roof.  Workers were observed climbing up and down this portable extension ladder.  The workers were exposed to falls of over 10 feet to dirt and concrete below.  This was most recently documented at 424 W. Cuming St., Lincoln, Nebraska on or about June 4, 2018 when the employer had employees working on the roof of this residence with the above listed issue present as they were going up and down the ladder on site.

29 CFR 1926.1060(a): The employer did not provide a training program for each employee using ladders and stairways, as necessary, which would enable each employee to recognize hazards related to ladders and stairways and train each employee in the procedures to be followed to minimize these hazards.  The employer is failing to provide employees with adequate and effective ladder safety training prior to allowing them to work on a residential style roof.  This training would allow each employee to recognize the hazards of falling and allow them to understand the proper procedures to be followed in order to minimize these hazards.  The area at the top of the ladder on site was entangled with air hoses that were running from the air compressor on the ground through the upper portion of the ladder and to the roof.  The workers were exposed to falls of over 10 feet to dirt and concrete below.  Had the employees had this training the above listed instances would not have been present on the job site.  The workers were exposed to falls of over 10 feet to dirt and concrete below.  This was most recently documented at 424 W. Cuming St., Lincoln, Nebraska on or about June 4, 2018 when the employer had employees working on the roof of this residence with the previously listed hazards present.
