OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to caught-in-between and amputation hazards: A) Findlay Vinyl, LLC, located at 1331 Broad Avenue, Unit 7, Findlay, OH 45840: On or about May 29, 2018, the employer did not ensure that two foot pedals, used to initiate the cycle of the Thermatron Radio Frequency Pneumatic Corner Press (Type P 20 A, Serial # 2748-83), were properly guarded to prevent unintentional activation of the press. Employees were exposed to caught-in-between and amputation hazards while using the press to weld together corners of the vinyl swimming pools. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence, or written records.
