29 CFR 1926.501(b)(10): Each employee engaged in roofing activities on low-slope roofs with unprotected sides and edges 6 feet or more above lower levels, was not protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and guardrail system, warning line system and safety net system, or warning line system and personal fall arrest system, or warning line system and safety monitoring system. Or, on roofs 50-feet (15.25 m) or less in width, each employee was not protected by use of a monitoring system. On or about June 5, 2018 on the west side of the roof of the building, the employer allowed employees to perform work on a low slope roof without the use of fall protection at an approximate height of 21 feet.

29 CFR 1926.502(h)(1)(v): The safety monitor had other responsibilities which could take the monitor's attention away from the monitoring function. On or about June 5, 2018 on the west side of the roof of the building, the employer allowed the foreman, which was the safety monitor, to perform work duties while he was supposed to be performing duties as a low slope roof safety monitor as employees worked near the edge of the roof.
