On or about June 5, 2018 one employee was working on a 24 inch wide plywood platform erected approximately 10 feet above the river bottom, to serve as a working platform to set concrete piles into a pile template for future pile driving into the river bed, and was not protected by any means of personal fall protection, guardrails or safety nets, exposing him to a fall of about 4 feet 8 inches, at high tide and 8 feet 2 inches at low tide into the Tolomato River below. High tide was estimated at 7:04 AM on June 5, 2018

29 CFR 1926.106(b): Prior to and after each use, the buoyant work vests or life preservers shall be inspected for defects which would alter their strength or buoyancy. Defective units shall not be used. a. On or about June 5, 2018 the employer did not assure inspections of life preservers was completed prior to the use of the life preserver, exposing employees to a drowning hazard. Saboungi Construction, was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.106, which was contained in OSHA inspection number 934323, citation number 1, item number 2 and was affirmed as a final order on September 12, 2013, with respect to a workplace located at 2455 Boat Ramp Road, New Smyrna Beach, FL 32168.
