OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing and struck-by hazards:      a) On or about June 7, 2018, employees were exposed to the hazard of being struck-by and/or crushed where safety barriers were not set up to protect the sides and rear areas of the swing pattern (swing areas and blind spots) of an excavator.           Among others, feasible and acceptable methods of abatement would include, setting up safety barriers to the sides and rear of the excavator's swing patters to prevent anyone from walking into the working area as described in the Association of Equipment Manufacturers Safety Manual for Hydraulic Excavators.    No abatement certification or documentation required for this violation.

Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing for likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards:      a) On or about June 7, 2018, employees were permitted to ride the bucket of an excavator to and from an excavation having a depth of approximately 9 feet.      Among others, feasible and acceptable methods of abatement would include, not allowing employees to enter the bucket of an excavator or other similar equipment as described in the Association of Equipment Manufacturers Safety Manual for Hydraulic Excavators.      No abatement certification or documentation required for this violation.
