29 CFR 1926.1153(c)(1): For each employee engaged in a task identified on Table 1, the employer did not fully and properly implement the engineering controls, work practices, and respiratory protection specified for the task on Table 1, and in the alternative, did not properly assesses the exposure of the employee to respirable crystalline silica in accordance with paragraph (d) of this section. a) James Hall, Rowan University, Glassboro, NJ: On or about June 6, 2018, A1 Construction Service employees were conducting masonry repairs to the brick exterior of a commercial building. Employees were using a hand held angle grinder to cut masonry and remove mortar. The saw was not equipped with engineering controls conforming to Table 1 Section (xi) of this standard creating a visible cloud of dust that potentially contained respirable silica. Additionally, the employer had not conducted a proper assessment of potential employee exposure to respirable crystalline silica. NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1910.134(c): The employer did not develop and implement a written respiratory protection program with required worksite-specific procedures and elements for required respirator use: (Construction Reference 1926.103) a) James Hall, Rowan University, Glassboro, NJ: On or about June 6, 2018, A1 Construction Service employees were conducting masonry repairs to the brick exterior of a commercial building. Employees were using a hand held angle grinder to cut masonry and remove mortar. The saw was not equipped with engineering controls and created a visible cloud of dust that potentially contained respirable silica. Employees were required by the employer to wear filtering facemask N95 respirators. The employer did not develop and implement a written respiratory protection program with required worksite-specific procedures and elements for required respirator use. NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
