29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent:    a) ColorCoat, Inc./Middlesex, NJ- Throughout the Plant: The employer did not administer a continuing, effective hearing conservation program for employees working in the plant and exposed to noise levels of 92.9 dBA (window cleaner), 91.0 dBA (window cleaner), 88.0 dBA (window cleaner), 92.1 dBA (painter). These levels exceeded OSHA Action Level of 82.7 dBA, which was adjusted based on extended 11 hour work shift. Sampling time was 621 minutes, 621 minutes, 497 minutes, and 621 minutes respectively. Zero exposures were assumed for all unsampled time periods.     Condition observed on or about June 5, 2018.

The employer did not institute a training program and ensure employee participation in the program:  ColorCoat, Inc./Middlesex, NJ- Throughout the Plant: The employer did not provide annual training for employees included in the hearing conservation program. Employees working in the plant are exposed to continuous noise levels of 92.9 dBA (window cleaner), 91.0 dBA (window cleaner), 88.0 dBA (window cleaner), 92.1 dBA (painter). These levels exceeded OSHA Action Level of 82.7 dBA, which was calculated for an extended 11 hour work shift. Sampling time was 621 minutes, 621 minutes, 497 minutes, and 621 minutes respectively. Zero exposures were assumed for all unsampled time periods.   Condition observed on or about June 5, 2018.
