OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to smoke inhalation and burn hazards while cleaning the coils on a physical vapor deposition oven that were encrusted with pyrophoric zirconium metal deposits:    (a) PVD Processing Area:  On or about 6/7/18 employees were exposed to smoke inhalation and burn hazards from the use of sparking tools while scraping pyrophoric zirconium metal residual off the coils of the VT-1 PVD oven.    (b) PVD Processing Area:  On or about 6/7/18 employees were exposed to the potential for smoke inhalation and burn hazards from the use of a spark producing (non-intrinsically safe)  wet/dry vacuum cleaner used to clean pyrophoric zirconium metal debris.

29 CFR 1910.132(d)(2): The employer did not verify, through a written certification, the identity of the workplace evaluated, the person certifying that the evaluation had been performed, and the date the hazard assessment was done:  (a) Workplace:  On or about 6/7/18 the employer did not verify, through a written certification, that a workplace hazard assessment for personal protective equipment needs had been performed and the date the hazard assessment was done.    Abatement Note:   Once the PPE Hazard Assessment is completed you shall:    1) Certify that the hazard assessment has been performed through a written certification in accordance with 1910.132(d)(2),    2) Provide training to affected employees in proper use of required PPE 1910.132 (f)(1).
