OSH Act of 1970 Section 5(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck by hazards from falling wood trusses:     Konkol Construction LLC., at the work-site located at 1655 Tee Road, Kronenwetter, WI: On or about June 11, 2018 employees erecting roof trusses on a single story ladder frame building were exposed to struck-by hazards while working on and/or under trusses that had not been braced to resist roll-over and/or collapse due to incomplete top chord lateral bracing, the lack of top chord diagonal bracing, the lack of bottom chord and web member bracing.

29 CFR 1926.20(b)(2): Such programs shall provide for frequent and regular inspections of the job sites, materials, and equipment to be made by competent persons designated by the employers:      On or about June 11, 2018 the employer or an employer representative did not conduct work-site inspection of the work-site located at 1655 Tee Road Kronenwetter, WI to ensure unsafe conditions were identified and corrected to eliminate employee exposure to fall and/or struck-by hazards.

29 CFR 1926.28(a): The employer is responsible for requiring the wearing of appropriate personal protective equipment in all operations where there is an exposure to hazardous conditions or where this part indicates the need for using such equipment to reduce the hazards to the employees:       On or about June 11, 2018 the employer did not require employees exposed to falling objects and/or debris to wear personal protective equipment (PPE) such as, but not limited to, safety glasses, hard hats, etc.

29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502:   On or about June 11, 2018 employees engaged in setting wood trusses on a residential construction site were not protected from a 14 feet fall hazard while working from wall top plates and trusses.

29 CFR 1926.503(a)(1): The employer shall provide a training program for each employee who might be exposed to fall hazards. The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards:  On or about June 11, 2018 the employer did not provide employees working from elevated surface above six feet with training to ensure they were able to recognize fall hazards and the implementation to minimize fall hazards.
