29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent: On or about June 13, 2018, at the Viking Turbo-Max pallet nailing machine, the employer did not implement a continuing, effective hearing conservation program for employee who were exposed to noise at an 8-hr time weighted average of 86.4 dBA which is greater then the action level of 85 dBA during the 8-hr sample period.

29 CFR 1910.95(i)(2): The employer did not ensure that hearing protectors were worn by employees whose exposures equaled or exceeded an 8-hour time-weighted average of 85 decibels: On or about June 13, 2018, at the Viking Turbo-Max pallet nailing machine, the employer allowed employees to operate Viking Turbo-Max Pallet machine without wearing hearing protection. Employees were exposed to noise at an 8-hr time weighted average of 90.8 dBA which is greater then the action level of 85 dBA during the 8-hr sample period.
