29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c): (a)T&R Contracting, Inc. at Intersection of Arrowhead Parkway and South Foss Avenue, Sioux Falls, SD 57110: On or about and at times prior to June 14, 2018, the controlling and exposing employer did not ensure employees were protected from cave-in and struck-by hazards in that, employees setting formwork for a collar between a reinforced concrete pipe and a manhole box, worked outside of a trench shield system in an excavation at a depth greater than 5 feet. This condition exposed employees to cave-in and struck-by hazards while working in a trench excavation approximately 12 feet in depth. (b)T&R Contracting, Inc. at Intersection of Arrowhead Parkway and South Foss Avenue, Sioux Falls, SD 57110: On or about and at times prior to June 14, 2018, the controlling and exposing employer did not ensure employees were protected from cave-in and struck-by hazards in that, employees accessed a trench excavation by walking between the exterior wall of a trench shield and the vertical excavated wall of the trench at a depth greater than 5 feet. This condition exposed employees to cave-in and struck-by hazards while working in an excavation approximately 12 feet in depth.

29 CFR 1926.651(k)(1): An inspection of the excavations, the adjacent areas, and protective systems was not conducted by the competent person prior to the start of work and as needed throughout the shift: (a)T&R Contracting, Inc. at Intersection of Arrowhead Parkway and South Foss Avenue, Sioux Falls, SD 57110: On or about and at times prior to June 14, 2018, the controlling and exposing employer did not ensure employees were protected from cave-in and struck-by hazards. A competent person did not conduct an inspection of the excavation, adjacent areas, points of access, and protective system prior to employees entering an excavation with a depth greater than 5 feet to perform work. This condition exposed employees to cave-in and struck-by hazards associated with working in an excavation approximately 12 feet deep.

29 CFR 1926.652(g)(1)(iii): Employees were not protected from the hazard of cave-ins when entering or exiting the area protected by shields: (a)T&R Contracting, Inc. at Intersection of Arrowhead Parkway and South Foss Avenue, Sioux Falls, SD 57110: On or about and at times prior to June 14, 2018, the controlling and exposing employer did not ensure employees were protected from cave-in and struck-by hazards in that, the ladder used to access the excavation was located between the exterior wall of the trench shield and the excavation wall during use. This condition exposed employees to cave-in and struck-by hazards associated with accessing a 12-foot deep trench excavation.
