29 CFR 1926.28(a): Appropriate personal protective equipment was not worn by employee(s) in all operations where there was exposure to hazardous conditions: a) Job Site, 10 Tiffany Drive, Scranton, PA - Employees operated a Caterpillar Model D6K Track-Type Tractor (Serial No. CAT00D6KHDHA01233) on a 14-16 degree grade without wearing the equipment manufacturer provided seat belt exposing the employees to struck-by, caught-in, and crushed-by hazards. An employee was ejected and suffered two broken legs after being crushed by a track of the bulldozer, on or about June 14, 2018. In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation.

29 CFR 1904.39(a)(2): The employer did not report an in-patient hospitalization, amputation, or loss of an eye as a result of a work-related incident to OSHA within twenty-four (24) hours. a) Job Site, 10 Tiffany Driver, Scranton, PA - An employee sustained a work-related injury on June 14, 2018 after being ejected from the cab of a Caterpillar Model D6K Track-Type Tractor (Serial No. CAT00D6KHDHA01233) that resulted in the employee being hospitalized with two (2) broken legs. The hospitalization was not reported by the employer to OSHA within twenty-four (24) hours, on or about June 15, 2018. In accordance with 29 CFR 1903.19, abatement certification is not required for this violation as the hazardous condition was corrected during the inspection.
