29 CFR 1910.146(c)(1): The employer did not evaluate the workplace to determine if any spaces were permit-required confined spaces:  a.) Ellwood Quality Steels Company, East Bay-  On or about June 19, 2018, and on dates prior thereto: employer had not evaluated the workplace to determine if 30 inch vertical molds were permit-required confined spaces.  Employees periodically entered 30 inch vertical molds during mold set-up operations. The molds contained, or potentially contained, hazards including but not limited to, a hazardous atmosphere and an internal configuration such that an entrant could be trapped by a floor which sloped downward and tapered to a smaller cross-section. The employer did not identify 30 inch vertical molds as permit required confined spaces.

29 CFR 1910.146(c)(2): When the workplace contains permit spaces, the employer did not inform exposed employees, by posting danger signs or by any other equally effective means, of the existence and location of and the danger posed by the permit spaces:  a.) Ellwood Quality Steels Company , East Bay - On or about June 19, 2018 and on dates prior thereto:  employees periodically entered 30 inch vertical molds during mold set-up operations. The molds contained, or potentially contained, hazards including, but not limited to, a hazardous atmosphere, and an internal configuration such that an entrant could be trapped by a floor which sloped downward and tapered to a smaller cross-section. The employer did not label nor post signs that identified the 30 inch vertical molds as permit required confined spaces.

29 CFR 1910.146(g)(1): The employer did not provide training so that all employees whose work is regulated by this section acquire the understanding, knowledge, and skills necessary for the safe performance of the duties assigned under this section.  a.) Ellwood Quality Steels Company, East Bay-  On or about June 19, 2018, and on dates prior thereto: employer had not evaluated the workplace to determine if 30 inch vertical molds were permit-required confined spaces.  Employees periodically entered 30 inch vertical molds during mold set-up operations. The molds contained, or potentially contained, hazards including but not limited to, a hazardous atmosphere and an internal configuration such that an entrant could be trapped by a floor which sloped downward and tapered to a smaller cross-section. Employees had not received the required training prior to entering permit-required confined spaces.
