29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems, hazardous atmospheres and or other hazardous conditions: (a) Avalon Maintenance, LLC, at W. Conejos Pl. between Julian and King Streets, Denver, CO 80204: On or before June 13, 2018, the exposing employer did not ensure that daily inspections of a trench, that was approximately 7.5 feet deep, and the adjacent area were made by the competent person for evidence of a situation that could have resulted in a hazardous condition. The competent person did not identify that the trench had near vertical walls and water at the bottom of the trench. This condition exposed employees to a crushing and struck-by hazard from excavation wall cave-in. Note: "Competent person" means one who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has authorization to take prompt corrective measures to eliminate them.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(b) or (c): (a) Avalon Maintenance, LLC, at W. Conejos Pl. between Julian and King Streets, Denver, CO 80204: On or before June 13, 2018, the exposing employer did not ensure that each employee conducting work in an excavation was protected from cave-in, in that work performed to uncover a sewer line main in preparation to make a tie-in and install a manhole vault was done in the area of the trench that was approximately 7.5 feet deep, had water at the bottom, and lacked a protective system. This condition exposed employees to a crushing and struck-by hazard from excavation wall cave-in.
