OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to excessive heat while performing landscape work at residential and commercial jobsites in that: a) On or about and at times prior to May 17, 2018, employees working on residential landscaping were exposed to the hazards of high ambient temperature and working in direct sunlight, which produced Wet Bulb Globe Temperatures (WBGT) of 82.5 degrees Fahrenheit (Heat Index of 89.9 degrees Fahrenheit), while performing heavy manual labor consisting of landscaping activities. Such exposures may lead to the development of serious heat-related illnesses such as, but not limited to, heat cramps, heat exhaustion, and heat stroke. b) On or about and at times prior to June 14, 2018, employees working on a commercial landscaping were exposed to the hazards of high ambient temperature and working in direct sunlight, which produced Wet Bulb Globe Temperatures (WBGT) of 88.5 degrees Fahrenheit (Heat Index of 96.8 degrees Fahrenheit), while performing heavy manual labor consisting of landscaping activities. Such exposures may lead to the development of serious heat-related illnesses such as, but not limited to, heat cramps, heat exhaustion, and heat stroke.
