29 CFR 1926.451(f)(6): Scaffolds were erected, used, dismantled, altered, or moved such that they, or any conductive material handled on them, could have come closer than the minimum distances established for specific voltages as set forth in the table in subparagraph (f)(6): (a) ICON Midtown Luxury Apartments, 37th floor of the Northeast Corner: On or about 05/18/2018, and at times prior, the employer exposed employees to electrical shock hazards, in that the swing stage scaffold used to install decorative metal panels was not kept at least 12-feet, 2-inches from the 115kv power transmission lines at street level. The wire support cables of the swing stage came in close proximity to the high power lines which created two explosions and a scaffold collapse on the right side of the swing stage platform.

29 CFR 1926.451(f)(7): Scaffolds were not erected, moved, dismantled, or altered, by trained and experienced employees under the supervision and direction of a competent person qualified in scaffold erection, moving, dismantling or alteration:; Such activities were not performed only by experienced and trained employees selected for such work by the competent person: a) ICON Midtown Luxury Apartments, 37th floor of the Northeast Corner: On or about 05/18/2018, and at times prior, the employer exposed employees to electrical shock hazards while moving and working from a swing stage scaffold system, in that the competent person or experienced and/or trained employees failed to keep the scaffold system a safe distance away from high powered transmission lines.
