29 CFR 1910.178(q)(7): Industrial trucks shall be examined before being placed in service, and shall not be placed in service if the examination shows any condition adversely affecting the safety of the vehicle. Such examination shall be made at least daily. Where industrial trucks are used on a round-the-clock basis, they shall be examined after each shift. Defects when found shall be immediately reported and corrected: Warehouse- On or about June 21, 2018, The employer failed to ensure adequate daily inspections were performed prior to use on each shift and failed to correct damaged battery cables. Employees required to use powered industrial trucks in the performance of their duties were thereby exposed to struck-by and caught-between hazards. Abatement documentation is required of this item in accordance with the requirements of 29 CFR 1903.19(d).

29 CFR 1910.176(b): Secure storage. Storage of material shall not create a hazard. Bags, containers, bundles, etc., stored in tiers shall be stacked, blocked, interlocked and limited in height so that they are stable and secure against sliding or collapse. Warehouse - On or about June 21, 2018, the employer failed to ensure product was stacked and blocked in such a manner as not to create a hazard from sliding and collapsing onto employees or into the path where employees operated powered industrial trucks. Employees were thereby exposed to struck-by, and caught-between hazards. Abatement documentation is required of this item in accordance with the requirements of 29 CFR 1903.19(d).
