29 CFR 1926.453(b)(2)(v): A body belt shall be worn and a lanyard attached to the boom or basket when working from an aerial lift. Note to paragraph (b)(2)(v): As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system. The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated under 1926.502(e). On June 19, 2018, located near a roadway, an employee was exposed to a fall hazard while working inside a vehicle-mounted aerial lift bucket without being attached to the boom or basket.

29 CFR 1926.454(a): The employer shall have each employee who performs work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards: On June 19, 2018, located near a roadway, an employee was exposed to a fall hazard while working inside a vehicle-mounted aerial lift bucket without the lanyard attached to the boom or bucket and had not been trained by a qualified person to recognize the hazards associated while operating an aerial lift and the procedures to be followed in order to minimize these hazards. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence, or written records.
