29 CFR 1926.102(a)(1): The employer did not ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation: (a)Milan Roofing, Inc. at 4420 West 93rd Street, Sioux Falls, SD 57108: On or about and at times prior to June 19, 2018, the exposing employer did not ensure that each employee that was installing roofing material with the use of a pneumatic nail gun was protected from flying objects by the use of appropriate eye protection. This condition exposed employees to eye injuries.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employees provided with an alternative fall protection measure under another provision of paragraph 1926.501(b): (a)Milan Roofing, Inc. at 4420 West 93rd Street, Sioux Falls, SD 57108: On or about and at times prior to June 19, 2018, the exposing employer did not ensure employees were protected from injury in that, employees engaged in roofing activities on a new single family home were exposed to falls in excess of 6 feet without the use of a fall protection system. This condition exposed employees to a fall hazard of approximately 16 feet. Milan Roofing, Inc. was previously cited for an equivalent Occupational Safety and Health Standard 29 CFR 1926.501(b)(10) which was contained in OSHA inspection number 1192529, citation number 1, item number 1 and was affirmed as a final order on March 1, 2017, with respect to a workplace located at 805 S. Kiwanis Avenue, Sioux Falls, SD 57104.
