Employees were using the frame to access working platform.

For falling objects too large, heavy or massive to be contained or deflected, the employer did not place and secure such potential falling objects away from the edge of the surface from which they could fall:  (a) On or about 06/25/18 - 156 Main Street, Trussville, AL, employees laying brick at approximately 13 feet above the ground were working from scaffolding that did not have toe boards installed.  There were 5 stacks of bricks on the working platform, and one employee was handing a tool from lower working platform to upper working platform.

"AND AS REFERENCED BY THE NOTE CONTAINED IN 1926.602(d)":  (a)  On or about 06/25/18 - 156 Main Street, Trussville, AL, an employee used a JLG, (Model number 6036; and Serial Number 0160068419) to raise stacks of bricks from the ground level to the working platform of a tubular scaffold.  The employee had not been trained to use the JLG.

29 CFR 1926.100(a): Employees working in areas where there is a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns, shall be protected by protective helmets:  (a)  On or about 06/25/18 - 156 Main Street, Trussville, AL, employees were not provided hard hats while working underneath scaffolding and passing tools to upper working platform.   (b)  Flores Masonry, LLC. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.100(a), which was contained in OSHA inspection number 1009839, citation number 1, item number 1, and was affirmed as a final order on 12/16/14, with respect to a workplace located at 3315 Chase Court at Brooke's Crossing, Trussville, AL.
