29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met:  a) On or about June 21, 2018; roof area; the employer had not developed a written hazard communication plan for chemicals such as but not limited to Henry Aluminum Roofing coating used in the sealing process.     In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the Certification of Corrective Action Worksheet).

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   a) On or about June 21, 2018; roof area; employees installing flashing along the outside edge of the roof were not wearing fall protection to prevent them from falling 30-35 feet to ground level.    In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the Certification of Corrective Action Worksheet), in addition, documentation demonstrating the abatement is complete must be included with your certification.  This documentation may include, but is not limited to evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

29 CFR 1926.503(b)(1): The employer did not verify compliance with paragraph (a) of this section by preparing a written (training) certification record including the name or other identity of the employee trained, the date(s) of the training and when employer also relied on training conducted by another employer, the certification record needs to indicate the date the employer determined the prior training was adequate rather than the date of actual training, and the signature of the person who conducted the training or the signature of the employer.    a) On or about June 21, 2018; roof area; the employer did not document fall protection training to employees that were exposed to fall hazards on the usage of fall protection and methods to abate or protect themselves while conducting their assigned duties.   In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the Certification of Corrective Action Worksheet).
