OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to fall, struck by, struck against hazards, and being ejected while riding unrestrained in the cargo area of a motorized vehicle. a) Corner of Rockaway Pkwy. and Wheeler Ave. Valley Stream NY - Employees riding in the back of a 1995 Mitsubishi Fuso landscaping dump truck were not restrained and were exposed to fall, struck by, struck against hazards, and being ejected out of a moving vehicle; on or about 6/26/18. Note: In addition to abatement certification the employer is required to submit abatement documentation for this item in accordance with 29 CFR 1903.19.
