29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet or more above lower levels was not protected by guardrail systems, safety net systems, or personal fall arrest systems. The employer is failing to protect employees from fall hazards associated with performing residential construction activity while exposed to falls 6 feet or greater. The most recent occurrence of this was observed on June 26th, 2018 at the new residential home located at 2714 N. 191st Ave Elkhorn, NE where the employer has a crew of 6 employees installing roof shingles exposed to fall hazards while they were working off the roof of the home without any form of conventional fall protection. Bates Roofing, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(11), which was contained in OSHA inspection number 1186473, citation number 1, item number 1 and was affirmed as a final order on November 2, 2016, with respect to a workplace located at 9542 Giles Road, LaVista, NE 68128.
