29 CFR 1926.20(b)(2): The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person: a) Royal Oak LLC, 68 Eagle Ridge Drive, Granby, CO 80446: On or before June 21, 2018, the controlling employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person. Subcontractors were working in two-story houses that had guardrails improperly installed. These conditions exposed subcontractor employees to fall hazards of up to approximately 11 feet. OSHA defines a "competent person" as someone capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to workers, and who has authorization to take prompt corrective measures to eliminate them.

29 CFR 1910.1200(g)(8): The employer did not maintain copies of the required safety data sheets for each hazardous chemical in the workplace: (a) Royal Oak LLC at 68 Eagle Ridge Drive, Granby, CO 80446: On or before June 21, 2018, the employer did not maintain a safety data sheet for each hazardous chemical and lubricants, flammable liquids, and combustible liquids used on location. These chemicals include Titebond Provantage Subfloor Adhesive, and Rust-Oleum Paint and Primer. This condition exposed employees to chemical irritations to eyes, respiratory, and skin due to employee lack of knowledge regarding chemical hazards. Abatement note: 29 CFR 1926.59 provides that the requirements applicable to construction work under this section are identical to those set for in 1910.1200 of this chapter.
