29 CFR 1910.178(o)(1): Load(s) on powered industrial truck(s) were not stable or safely arranged:  At a jobsite located at 4920 SW Marguerite Street, Blue Springs, Missouri (Lot #37), employees were exposed to serious struck by hazards from falling or swinging loads in the following instances:  a) Employees using a JLG G10-55A rough terrain forklift (S/N 0160067393) to lift trusses to the upper level of the structure were exposed to struck by hazards in that loads were suspended from a single fork.  b) Employees using a JLG G10-55A rough terrain forklift (S/N 0160067393) to lift trusses to the upper level of the structure were exposed to struck by hazards in that loads suspended from the fork were not controlled using tethers, tag lines, or similar.

29 CFR 1926.100(a): Employees were not protected by protective helmets while working in areas where there was a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns:  At a jobsite located at 4920 SW Marguerite Street, Blue Springs, Missouri (Lot #37), employees were exposed to serious struck by hazards, in that employees working in the path of loads being raised and moved by forklift did not wear protective helmets or hard hats.

29 CFR 1926.403(b)(1)(i): Safety of equipment was not determined on the basis of suitability of the equipment for an identified purpose as evidenced by listing, labeling, or certification for that identified purpose.  At a jobsite located at 4920 SW Marguerite Street, Blue Springs, Missouri (Lot #37), employees were exposed to electric shock and fire hazards in that electrical junction boxes were used for purposes not approved by listing, labeling, or certification. Junction boxes were used as pendant-type receptacles.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m)  or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501 (b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502:     At a jobsite located at 4920 SW Marguerite Street, Blue Springs, Missouri (Lot #37), employees were exposed to serious fall hazards in the following instances:    a) Employees were standing on a section of the building approximately 11 feet high while moving trusses from the forklift to the sections of the building being framed. No fall protection system or plan was in place to protect employees from fall hazards at the edges of the building or around stairwells.     b) Employees working on and walking through the interior of the building were exposed to fall distance of approximately 11 feet in that there were unprotected floor edges above the basement of the structure.      Irwin Construction Co LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard (1926.501(b)(2)(i)), which was contained in OSHA inspection number 1131231, citation number 1, item number 1 and was affirmed as a final order on (3/31/16), with respect to a workplace located at 3908 NE Independence Ave. Lees Summit, Missouri.
