29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met: Employees were exposed to chemical hazards. Employees engaged in maintenance and repair activities using chemicals, including but not limit to amorphous fumed silica, were exposed to chemical hazards in that written hazard communication program was not established.

29 CFR 1910.134(c)(1): In any workplace where respirators are necessary to protect the health of the employee or whenever respirators are required by the employer, the employer shall establish and implement a written respiratory protection program with worksite-specific procedures. The program shall be updated as necessary to reflect those changes in workplace conditions that affect respirator use. The employer shall include in the program the following provisions of this section, as applicable: Employees were exposed to respiratory hazards. Employees required to use respiratory protection while engaging in maintenance activities throughout the facility were exposed to health hazards in that a comprehensive written respiratory protection program had not been developed and implemented.
