On or about 2 July 2018, and at times prior thereto, two employees were utilizing an aerial lift to perform tree cutting activities in which the combined weight exceeded the weight capacity for the lift, exposing both employees to the lift toppling over with a fall hazard of approximately 10 feet 1 inch to the ground below.

29 CFR 1910.151(b): There was neither an infirmary, clinic, or hospital used for the treatment of all injured employees in near proximity to the workplace nor a person or persons adequately trained to render first aid. On or about 2 July 2018, and at times prior thereto, three workers were performing tree cutting activities at a site that was not in near proximity to medical assistance, nor was there a person on site that was adequately trained to render first aid. During the course of work, one of the workers fell from a one-story roof, suffering fatal injuries.

29 CFR 1904.39(a)(1): The employer did not report within 8-hours the death of an employee resulting from a work-related incident. On 2 July 2018, at approximately 9:30 AM, an employee fell off a one-story roof resulting in traumatic injuries requiring hospitalization. During the hospitalization, the employee died at approximately 3:03 PM. The fatality was not reported within 8-hours to the local Area Office of the Occupational Safety and Health Administration. The Austin Area Office was notified on 3 July 2018 at approximately 9:00 AM or approximately 18 hours later.
