29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.    a) TDS Contracting located at 8369 Lowery Blvd, Denver, CO 80230: On and preceding July 5th 2018, the employer did not ensure that employees working on the second floor of a three story residential  apartment building were protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.  The internal staircase, which will lead from the second level to the third floor, did not have steps or a guardrail system installed to prevent a fall from the stairwell to the lower level.   The lack of steps and or a guardrail created an opening that measured approximately 4 feet wide, the height of the staircase and dropped approximately 11 feet onto the staircase below.  Workers were installing wall studs and storing tools in the area around the opening.  The following condition exposed employees to falls from up to 11 feet.    b) TDS Contracting located at 8369 Lowery Blvd, Denver, CO 80230: On and preceding July 5th 2018, the employer did not ensure that employees working on the second floor of a three story residential  apartment building were protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.  The perimeter of the southeast section of the building had several wall openings that measured up to 20 1/2 inches wide and up to 5 feet high.  The edges dropped approximately 10-11 feet to the ground level below. Workers were installing wall studs throughout the second level and the southeast portions of the building was an area the workers regularly walked through, putting them in close proximity to the wall openings.  The following condition exposed employees to falls from up to 11 feet.

29 CFR 1926.1052(c)(1)(i): Stairways having four or more risers or rising more than 30 inches (76 cm), whichever is less, were not equipped with at least one handrail:  a) TDS Contracting located at 8369 Lowery Blvd, Denver, CO 80230: On and preceding July 5th 2018, the employer did not ensure that stairways having four or more risers were equipped with at least one handrail.  The internal staircase, which will led from the ground level to the second floor, was a means for accessing the second level for all workers carrying tools and equipment.  The following condition exposed employees to falls from height.
