29 CFR 1910.134(c)(2)(ii): The employer did not establish and implement those elements of a written program necessary to ensure that any employee using a respirator voluntarily was medically able to use that respirator, and that the respirator was cleaned, stored, and maintained so that its use does not present a health hazard to the user: (a) On or about June 26, 2018, and at times prior, the employer did not provide a written respiratory protection program for voluntary use of elastomeric half-face air purifying respirators while working in the manufacturing area. As a result, employees were not medically cleared prior to wearing the respirator and were not trained on how to clean, store, and maintain the respirator so its use does not present a health hazard.

29 CFR 1910.132(d)(1)(ii): When the employer had assessed the workplace hazard(s) and determined that hazard(s) were present, the employer did not communicate the selection decision(s) to each affected employee: (a) On or about June 26, 2018, and at times prior, employees were at risk of chemical injury while using personal protective equipment that was not adequate to protect employees from chemical exposure. Employees wear protective gloves while using chemicals such as (but not limited to) acetone, kerosene, and methyl ethyl ketone. Employees have several options for chemical protective gloves available (including but not limited to latex, nitrile, and butyl) but were not aware of glove protection limitations. Dermal exposure to acetone, kerosene, and methyl ethyl ketone can lead to defatting of the skin.
