29 CFR 1926.20(b)(2): Such programs shall provide for frequent and regular inspections of the job sites, materials, and equipment to be made by competent persons designated by the employers. On July 9, 2018, there were no frequent and regular inspections being performed by a competent person in that: (a) an employee was working on roof caps from a residential roof at fall heights greater than 25 feet above the next lower level without a fall protection system; (b) a damaged snap hook that was rusted and locked in the open position was being used for fall arrest at the jobsite; and (c) a damaged lanyard that had excessive hardness due to paint stains and dried mastic was being used for fall arrest at the jobsite.

29 CFR 1926.21(b)(2): The employer shall instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury. On July 9, 2018, located on the north side of a residential structure, an employee was operating a JLG 860SJ aerial lift that had not been instructed on the applicable procedures and/or regulations to minimize those hazards while performing this work. Potential fall height was measured to be greater than 25 feet above the ground below.

29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502. Note: There is a presumption that it is feasible and will not create a greater hazard to implement at least one of the above-listed fall protection systems. Accordingly, the employer has the burden of establishing that it is appropriate to implement a fall protection plan which complies with 1926.502(k) for a particular workplace situation, in lieu of implementing any of those systems. On July 9, 2018, located on the north side of a residential structure, an employee was performing roof cap work without using a fall protection system and exposed to unprotected sides or edges. Potential fall heights were determined to be greater than 25 feet above the ground below.
