29 CFR 1910.23(c)(8) The employer did not ensure that the top cap and the top step of a step ladder were not used as steps: (a) Mechanicsville Family Apartments, Building/Track #2 on third floor: On or about 07/10/2018, and at times prior, the employer exposed employees to fall hazards of approximately 8-feet to the lower ground level, in that the ladder provided to access the attic area was not a safe option as the top step and ladder cap were used to gain access to the upper level which created a fall hazard. The employer failed to use a ladder that extended past the landing of the upper level.
