OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing injuries from a forklift overturning or from the operator falling off the forklift, due to the fact that operator restraint systems (seat belts) provided, were not used by the operator. Among other methods, one feasible and acceptable method to correct this hazard is for the employer to effectively enforce the use of the operator restraint systems  during forklift operation.     a) Pierside Street Lay-Down Yard: An employee operating a Toyota forklift model 7FGU25, serial number 81627, was observed not wearing a seat belt while moving 55 gallon metal drums from a truck to a storage area.
