29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury: (a) The employer did not train employees on how to recognize and avoid heat-related hazards that were present in the workplace. On July 20, 2018, unacclimatized employee(s) installing PVC piping for foundation drains were exposed to elevated environmental heat hazards (Heat Index > 90 deg. F), resulting in the development of heat-related illness. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence, or written records.

29 CFR 1926.50(b): Provisions were not made prior to commencement of the project for prompt medical attention in case of serious injury: (a) On July 10, 2018, provisions were not in place to provide prompt medical care to an employee who suffered from heat related illness on the construction site located at 4639 Vermona Drive, Cincinnati, OH. An unacclimatized employee was hospitalized with heat stroke on his second day on the job. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence, or written records.

(a) On July 10, 2018, a recordable illness occurred when an employee suffered from heat related illness and was hospitalized. (b) On July 9, 2018, a recordable illness occurred when an employee lost consciousness on the worksite. (a) On July 12, 2018, copies of the OSHA 300 Logs and 300A forms for the calendar years 2015, 2016, 2017 and 2018 year to date were requested at approximately 10:30 am. The 300 Logs were received in a timely manner, but the 300 A forms were not received until July 17, 2018. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET)
