29 CFR 1910.146(d)(4)(vii): Under the permit-required confined space program required by 29 CFR 1910.146(c)(4), the employer did not ensure that equipment, such as ladders, needed for safe ingress and egress by authorized entrants were used properly:     Conveyor 81A:  On, or about, July 10, 2018, an employee who entered the screening unit was not provided with a ladder, steps or other appropriate means to access the hatch opening.  He was observed climbing up the side of the machine.

29 CFR 1910.146(c)(2): The employer did not inform exposed employees, by posting danger signs or by any other equally effective means, of the existence and location of and the danger posed by the permit spaces:    Conveyor 81A:  On, or about, July 10, 2018, the access cover to the screener section of the machine was provided with a sign that identified the space as a non-permit required space.  Using both the guidelines in 29 CFR 1910.146 and the employer's Confined Space Determination Worksheet, the screener section is classified as a Permit Required Confined Space due to the internal configuration of the space, a fall hazard in the space and the requirement that employees stand on rotating conveyor shafts that are required to be locked out.

29 CFR 1910.146(d)(4)(iv): Under the permit-required confined space program required by 29 CFR 1910.146(c)(4), the employer did not ensure that employees used the personal protective equipment properly:  Conveyor 81A:  On, or about, July 10, 2018, the personal fall arrest system provided for the employee to use when accessing the screener unit required that he unhook from the lower anchor point to secure the lanyard to the horizontal shaft used as the upper anchor point.  The employee was provided with a single lanyard.

29 CFR 1910.147(c)(4)(i): Procedures were not developed, documented and utilized for the control of potentially hazardous energy when employees were engaged in activities covered by this section:    A.  Fiber Baler:  On, or about, July 9, 2018, an employee suffered serious hand injuries while assisting with a manual baler wire insertion.  The Harris HLO baler had not been turned off and locked out and the task required the employee to reach into a hazardous area of the machine.    B.  Conveyor 81A:  On, or about, July 10, 2018, an employee entered the screener section of the machine for daily cleaning.  The machine was not locked out at the main disconnect in accordance with the established procedure, instead one of the three shaft motors was used.  Also, the machine controls were not operated to ensure that the conveyor shafts were properly locked out.

29 CFR 1910.147(c)(7)(i)(A): Authorized employee(s) did not receive training in the recognition of applicable hazardous energy sources, the type and magnitude of the energy available in the workplace, and the methods and means necessary for energy isolation:  A.  Fiber Baler:  On, or about, July 9, 2018, an employee who worked as a Baler Operator for three weeks was not trained regarding lockout procedures to be used when inserted bale wire.  The employee had received general training, but had not been trained regarding when to lock the equipment out or how to lock the equipment out.    B.  Conveyor 81A:  On, or about, July 10, 2018, an employee accessed the screener section for daily cleaning.  The machine was not locked out at the main disconnect because a section of the machine was still running.  The employee affixed a lock onto one of the three shaft motor disconnects, leaving the other two unlocked.  When a second employee arrived, a group hasp was not used.  The employees did not appear to have a working knowledge of the fundamental mechanics of applying lockout devices.

FCR, LLC was previously cited for a violation of an equivalent standard [29 CFR 1910.212(a)(1)], which was contained in OSHA Inspection Number 1174976, Citation Number 1, Item Number 1 and was affirmed as a Final Order on October 24, 2016, with respect to a workplace located at Hartford, Connecticut.
