29 CFR 1926.21(b)(2): The employer shall instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury. On or about June 28, 2018, at the Job 755 jobsite, employees performing maintenance on a Cat D300E Series II #301 were not trained in the hazardous energy sources and how to control them.

29 CFR 1926.600(a)(3)(i): Heavy machinery, equipment, or parts thereof, which are suspended or held aloft by use of slings, hoists, or jacks shall be substantially blocked or cribbed to prevent falling or shifting before employees are permitted to work under or between them. Bulldozer and scraper blades, end-loader buckets, dump bodies, and similar equipment, shall be either fully lowered or blocked when being repaired or when not in use. All controls shall be in a neutral position, with the motors stopped and brakes set, unless work being performed requires otherwise. On or about June 18, 2018, at the jobsite, the brakes became inoperable the Cat D300E Series II during the repair of a the drive shaft resulting in it rolling down the hill.

29 CFR 1926.600(a)(3)(ii): Whenever the equipment is parked, the parking brake shall be set. Equipment parked on inclines shall have the wheels chocked and the parking brake set. On or about June 28, 2018, at the Job 755 jobsite, the wheels were not chocked on the #301 Cat D300E Series II while repairing the driveshaft resulting in it rolling down the hill.
