29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m)  or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501 (b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502:   a) At 112 Nicholas Pkwy worksite, on or about July 11, 2018, employees were installing truss and roof sheathing lumber on a 5:12 pitch elevated working surface without a fall protection system. Employees were exposed to a fall hazard of approximately 8 feet.     a) At 116 Nicholas Pkwy worksite, on or about July 11, 2018, employees were installing truss and roof sheathing lumber on a 5:12 pitch elevated working surface without a fall protection system. Employees were exposed to a fall hazard of approximately 8 feet.

29 CFR 1926.1053(b)(1): Because of the portable ladder's length, the ladder side rails did not extend to at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access and the ladder was not secured at its top to a rigid support that will not deflect, and/or a grasping device was not provided to assist employees in mounting and dismounting the ladder  a) At the 112 Nicholas Pkwy worksite, on or about July 11, 2018, employees were using an extension ladder to gain access to the upper landing surface that had the side rails extended approximately 1 foot above the upper landing surface. Employees were exposed to a fall hazard of approximately 7 feet 11 inches.

The ladders were not used in accordance with the purpose for which they were designed. Employees were exposed to a fall hazard of approximately 7 feet 11 inches.

Employees were stepping on the top of the step ladder to access the upper working surface. Employees were exposed to a fall hazard of approximately 7 feet 11 inches.
