29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury: The employer did not provide a workplace free from recognized hazards to employees required to work in unsafe heat related conditions. The employer did not instruct the employees in hazard recognition of heat related illnesses and conditions, and how to avoid and eliminate the hazards. This violation was discovered on or about July 07, 2018, where laborers performing the task of applying e-layer on a sports field (Gateway Park) located at 751 Beach Street, Fort Worth, Texas 76111 were subjected to the recognized hazard of excessive heat. Several occupational heat illnesses have occurred at the employer's workplaces, and can be found on the employer's OSHA 300 logs. a. On 08/12/2015 a GC laborer suffered from heat exhaustion. b. On 07/08/2016 a GC laborer suffered from heat exhaustion and dehydration. c. On 07/14/2016 a GC laborer suffered from heat exhaustion and dehydration. d. On 07/22/2016 a TF laborer suffered from heat exhaustion and dehydration. e. On 08/09/2016 a GC laborer suffered from heat exhaustion and dehydration that involved a day away from work. f. On 08/10/2016 a paving foreman suffered from heat exhaustion and dehydration that involved a day away from work. g. On 08/29/2016 a GC operator suffered from heat exhaustion and dehydration. h. On 08/30/2016 a TK laborer suffered from heat exhaustion and dehydration that involved a day away from work. i. On 07/07/2017 a laborer suffered from heat exhaustion. j. On 07/18/2017 a laborer suffered from heat exhaustion. k. On 07/20/2017 a laborer suffered from heat exhaustion. l. On 08/22/2017 a laborer suffered from heat exhaustion. m. On 06/23/2018 a laborer suffered from heat exhaustion that involved days away from work. n. On 06/28/2018 a laborer suffered from heat exhaustion.
