29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502.  a. On or about July 12, 2018, located at 663 Viola Drive in Sunbury, Ohio, an employee was installing floor joists while standing on the top plate and other floor joists without any means of fall protection, thereby exposing the employee to a fall hazard of approximately 12 feet, 6 inches.   b. On or about July 12, 2018, located at 663 Viola Drive in Sunbury, Ohio, employees were framing a residential home while there was an open floor hole to the basement that was approximately 11 feet long by 6 feet long, thereby exposing the employees to a fall hazard of approximately 9 feet.

29 CFR 1926.1053(b)(13): The top or top step of a stepladder shall not be used as a step.  a. On or about July 12, 2018, located at 663 Viola Drive in Sunbury, Ohio, an employee descended the top of a residential home's floor joists onto the top plate of a stepladder, thereby exposing the employee to a maximum fall hazard of six feet.
