OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees were exposed to crushing hazards: a. On or about July 12,2018, throughout yard area, employees operating forklifts were not wearing seatbelts, exposing themselves to crushing hazards. Among feasible means of abatement include but not limited to: 1. Utilizing seatbelts in accordance with ASME/ANSI B56.1-2012, paragraphs 5.3.19 and 7.41. 2. Creating and enforcing a forklift safety program which ensures protective devices are used.
