29 CFR 1926.451(g)(1)(vi): Each employee performing overhand bricklaying operations from a supported scaffold was not protected from falling from all open sides and ends of the scaffold (except at the side next to the wall being laid) by the use of a personal fall arrest system or guardrail system (with minimum 200 pound toprail capacity). For the employees laying brick and helping on or about July 10, 2018 and times prior there to, the employer did not provide fall protection to employees entering the area of walk through scaffold approximately 12 feet above the ground to unload material being delivered by the all terrain material handler and moving the material to the scaffold deck.

29 CFR 1926.1153(c)(1): The employer did not fully and properly implement the engineering controls, work practices, and respiratory protection specified for the task on Table 1, for each employee engaged in a task identified on Table 1, unless the employer assesses and limits the exposure of the employee to respirable crystalline silica in accordance with paragraph (d) of this section. For the employees cutting red brick using a chop saw on or about July 10, 2018 and times prior there to the employer did not implement the engineering controls listed on table 1 to control silica dust.
