29 CFR 1910.67(c)(2)(ii): Only trained persons shall operate an aerial lift: On or about June 26, 2018, the employer failed to ensure that an employee tasked with operating a borrowed (Bil-Jax 3632T) articulating boom lift, was provided training prior to allowing the employee to operate this piece of equipment. The untrained worker who was tasked with prepping the exterior of a commercial property located at 112 E. Bridge St. in Elyria, OH, was observed working from the basket of the boom lift without fall protection, at a height over 16 (+) feet.

29 CFR 1910.67(c)(2)(v): A personal fall arrest or travel restraint system that meets the requirements in subpart I of this part was not worn and attached to the boom or basket when working from an aerial lift: On or about June 26 2018, the employer failed to ensure that employees using a (Bil-Jax 3632 T) articulating boom lift during the removal/prepping of a commercial property in Elyria, OH was tied off or connected to the boom or basket of the lift by either a personal fall arrest or travel restraint system. The employee was working at a height of 16 (+) feet, and thus was potentially exposed a fall hazard.
