29 CFR 1917.95(b)(1)(ii): The employer did not provide and direct the wearing of personal flotation devices for those employees working in physically limited spaces that created a hazard of falling into the water. (a) On or about 07-16-2018 and times prior thereto, located at Virginia Pilot Corporation; 3329 Shore Drive Virginia Beach, VA 23451: Employee(s) were exposed to falls into the water exceeding 4 feet at and around areas surrounding a berthed Hampton Roads Pilot Vessel beneath a suspended Marine Travel Lift crane without wearing any personal flotation devices. Employee(s) had to step off of the pier and across unguarded work surfaces over water to access the crane operators platform. without PFD. The observed employee was unable to walk unassisted without using a medical knee-scooter with a hard protective left ankle/foot splint. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employee(s) and their representatives were informed of this abatement.

29 CFR 1917.112(b)(1): Guardrails were not provided at locations where employees were exposed to floor or wall openings or waterside edges, including bridges or gangway-like structures leading to pilings or vessel mooring or berthing installations, which presented a hazard of falling more than 4 feet or into the water.: (a) On or about 07-16-2018 and times prior thereto, located at Virginia Pilot Corporation; 3329 Shore Drive Virginia Beach, VA 23451: Employee(s) were exposed to falls into the water exceeding 4 feet at and around areas surrounding a berthed Hampton Roads Pilot Vessel beneath a suspended Marine Travel Lift crane.
