OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees where employees were exposed to a struck-by and impalement hazard from improper use of equipment with an improperly installed attachment: a) On June 27, 2018 an employee used a Liebherr 542 front-end wheel loader with a locally manufactured hay tine attachment installed on it to drive a fence pole into the ground. The loader operator positioned the attachment above the pole and used the attachment and loader to push down on it. Because the hay tine attachment was not fully engaged on the loader coupler, the upward force caused the attachment to come completely disengage from the loader coupler. b) On June 27, 2018 an employee used a Liebherr 542 front-end wheel loader with a hay tine attachment installed on it to drive a fence pole into the ground. The employee stood underneath the front of the front-end loader and attachment. Because the hay tine attachment was not fully engaged on the loader coupler, the upward force caused the attachment to come completely disengage from the loader coupler. Note) Certification and documentation of corrective actions are required for this item.
