29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed: Construction Site: On or about June 25, 2018; an employee was observed using a ladder that did not have the ladder side rails extend at least 3 feet (.9 m) above the 3rd floor deck landing surface being egressed. This condition exposed the employee to a fall hazard.

29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. Construction Site: On or about June 25, 2018; two employees were observed working next to the edge of the 4th floor deck without utilizing any type of the fall protection equipment. This condition exposed the employees to a fall greater than 6-ft. to the ground below. Cowboy Construction was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(10), which was contained in OSHA inspection number 1233642, citation number 01, item number 001 and was affirmed as a final order on February 5, 2017, with respect to a workplace located at 3500 Joe Battle Blvd., El Paso, TX 79938.
