29 CFR 1926.52(a): Protection against the effects of noise was not provided for employee(s) exposed to sound levels which exceeded those listed in Table D-2 of 29 CFR part 1926.52: a) On July 13, 2018, in the jobsite located at lot #16 of the "On Top of the World" community, the employer failed to ensure that employees exposed to sound levels exceeding 90 dBA as listed in the Table D-2 of this section, were provided and used hearing protection. A representative noise dosimetry showed that an employee cutting cement blocks with a Stihl handheld concrete saw model TS420 was exposed to a dose of 131.8% equivalent to 92 dBA as Time Weighted Average (TWA).

29 CFR 1926.52(d)(1): In all cases where the sound levels exceeded the values shown in Table D-2 of 29 CFR 1926.52, a continuing, effective hearing conservation program was not administered: a) On July 13, 2018, in the jobsite located at lot #16 of the "On Top of the World" community, the employer failed to ensure a hearing conservation program for the protection of employees exposed to sound levels exceeding 90 dBA as listed in the Table D-2 of this section. A representative noise dosimetry showed that an employee cutting cement blocks with a Stihl handheld concrete saw model TS420 was exposed to a dose of 131.8% equivalent to a TWA noise level of 92 dBA.
