On or about July 13, 2018, at the jobsite located next to the service road of the "On top of the World" community, Ocala Florida, the employer did not ensure that a safe mean of egress was located in the five feet deep excavation to be used for the expedite evacuation in case of an emergency.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c). a. On or about July 13, 2018, at the jobsite located next to the service road of the "On top of the World" community, Ocala Florida, the employer did not implement protective systems such as shoring or slopping configurations for Type C soil to prevent employees to be exposed to cave-ins while working inside an excavation five feet deep installing a pipe end cap.

29 CFR 1926.651(j)(2): Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet (.61m) from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary. a. On or about July 13, 2018, at the jobsite located next to the service road of the "On top of the World" community, Ocala Florida, the employer did not implement controls or work practices to prevent employees exposure to excavated material falling or caving into the excavation while installing a sewer pipe-end cap. Excavated material was place on the edge of the excavation exposing the employees to caught-in and struck-by hazards.
