29 CFR 1926.453(b)(2)(v): A body belt was not worn and/or a lanyard was not attached to the boom or basket when working from an aerial lift: Note:  As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system.  The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated.  a) Worksite, 115 Montauk Highway, Westhampton Beach, NY 11978 - Employees were doing painting work on a commercial building from a JLG Aerial Lift Model No. 400S/Serial No. 0300182244 approximately 11 feet above the ground with no fall protection; on or about 07/12/2018.  Note:   Because abatement of this violation is already documented in the case file, the employer need not submit certification or documentation of abatement for this violation as normally required by CFR 1903.19.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:  a) Worksite, 115 Montauk Highway, Westhampton Beach, NY 11978 - An employee performing painting work on a commercial building while using a JLG Aerial Lift Model No. 400S/Serial No. 0300182244 was exposed to fall hazards and was not trained, on or about 07/12/2018.  Note:  The employer is required to submit abatement certification for this item in accordance with 29 CFR 1903.19.
