29 CFR 1926.20(b)(2): Such programs shall provide for frequent and regular inspections of the job sites, materials, and equipment to be made by competent persons designated by the employers.  The employer fails to provide fall protection for employees engaged in residential construction.  The most recent incident of such failure occurred on July 17, 2018. There were no frequent and regular inspections being performed by a competent person in that:  (a) employees were performing work from a ladder jack without utilizing a fall protection system and exposed to fall heights greater than 11 feet above the concrete surface below   (b) employees were using a portable extension ladder, for both access and siding work, that was positioned at a 50 degree angle and was not secured to prevent accidental displacement (due to the ladder angle)  (c) the area around the base of the access ladder was obstructed with siding, lumber and an air hose   (d) employees were not provided with falling object protection in that the garage entrance (where the foreman was cutting siding) was located immediately below the ladder jack platform where employees were installing siding  (e) fall protection harnesses, lanyards and anchors were not available on-site for employee use    Samuel and Maria Llano Falcon Construction was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.20(b)(2), which was contained in OSHA inspection number 1258843, citation number 1, item number 1 and was affirmed as a final order on 1/04/2018, with respect to a workplace located at  4222 Mount Carmel Tabasco Rd., Cincinnati OH 45255.

29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502. Note: There is a presumption that it is feasible and will not create a greater hazard to implement at least one of the above-listed fall protection systems. Accordingly, the employer has the burden of establishing that it is appropriate to implement a fall protection plan which complies with 1926.502(k) for a particular workplace situation, in lieu of implementing any of those systems.  The employer fails to provide fall protection for employees engaged in residential construction.  The most recent incident of such failure occurred on July 17, 2018. Located on the northwest side of a residential structure, employees were performing siding work without using a fall protection system and exposed to fall heights greater than 11 feet above the ground below.  Samuel and Maria Llano Falcon Construction was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1258843, citation number 1, item number 2 and was affirmed as a final order on 1/04/2018, with respect to a workplace located at  4222 Mount Carmel Tabasco Rd., Cincinnati OH 45255.

29 CFR 1926.503(a)(1): The employer shall provide a training program for each employee who might be exposed to fall hazards. The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards.  The employer fails to provide fall protection for employees engaged in residential construction. The most recent incident of such failure occurred on or about July 17, 2018.The employer did not provide a training program for employees that were performing work from a ladder jack while not utilizing a fall protection system and exposed to fall heights greater than 11 feet above the concrete surface below.  Samuel and Maria Llano Falcon Construction was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.503(a)(1), which was contained in OSHA inspection number 1258843, citation number 1, item number 3 and was affirmed as a final order on 1/04/2018, with respect to a workplace located at  4222 Mount Carmel Tabasco Rd., Cincinnati OH 45255.
